By ordering a training course, the client unreservedly accepts these general terms and conditions of sale, which take precedence over any other document from the buyer, particularly their general purchasing conditions.
Upon the Client’s request, MY-BEAUTY ACADEMY will send them two copies of a continuing professional training agreement, as required by law. The client engages MY-BEAUTY ACADEMY by promptly returning a signed copy, stamped with their company seal.
Registration is officially confirmed once this document is signed.
At the end of the training, a certificate of attendance will be sent to the Client’s Training Department.
Prices, Invoicing, and Payment
All our prices are quoted excluding taxes. They are subject to the applicable VAT rate. Any training that has started is due in full. Unless otherwise stated, the prices include the trainer’s travel and meal expenses.
Invoices are payable, without discount, to the order of the company MY-BEAUTY ACADEMY upon receipt of the invoice.
Late Payment Penalties
In the event of late payment, an indemnity calculated at three times the current legal interest rate, in accordance with Article L 441-6 of the French Commercial Code, will be due, as well as a fixed compensation of 40 euros for recovery costs. These penalties are automatically payable upon receipt of the notice informing the Client that they have been debited.
Order Refusal
If a Client registers for a MY-BEAUTY ACADEMY training without having paid for previous courses, MY-BEAUTY ACADEMY reserves the right to refuse the order and deny participation in the training, without the Client being entitled to any compensation, for any reason.
Cancellation and Postponement Conditions for Training Sessions
Any cancellation by the Client must be communicated in writing. For any cancellation, even in the event of force majeure:
- If a cancellation occurs before the start of the service and the training session is postponed within 12 months from the date of the order, the total payment made by the Client will be credited in the form of a voucher applicable to future training. If no postponement is made within this 12-month period, the payment will be retained by MY-BEAUTY ACADEMY as a fixed compensation.
- If a cancellation occurs during the training, the payment will be retained by MY-BEAUTY ACADEMY as a fixed compensation.
In the event of subrogation, the Client agrees to pay the amounts not covered by the organism.
Cancellation and Postponement Conditions for a Training Session
The client may cancel a training session, provided that the cancellation occurs at least three business days before the scheduled date and time. Any session cancellation must be communicated by phone and email. The session may then be rescheduled based on the trainer’s availability.
Consumer Mediation:
National or cross-border disputes concerning the validity, interpretation, execution or non-execution, interruption, or termination of this agreement may be submitted to consumer mediation at the consumer’s request.
Consumer mediation refers to an out-of-court dispute resolution process, where a consumer and a professional attempt to reach an amicable agreement to resolve a dispute between them, with the assistance of a third party—the mediator. If no amicable agreement is reached, the mediator proposes a solution to resolve the dispute.
However, the consumer can only refer the matter to the mediator after having first made an effort in writing directly to the concerned professional or their customer service to try to resolve the dispute. If this step is not taken, the request for mediation will be inadmissible.
The dispute cannot be reviewed by the mediator if:
- The client has not attempted to resolve the dispute directly with MY-BEAUTY ACADEMY by written complaint,
- The request is clearly unfounded or abusive,
- The dispute has already been reviewed or is currently being reviewed by another mediator or court,
- The consumer submitted the mediation request more than one year after their written complaint to MY-BEAUTY ACADEMY,
- The dispute does not fall within the mediator’s jurisdiction.
Mediation is free for the client (unless they voluntarily seek the services of a lawyer, third party, or expert of their choice).
The mediator will not receive any instructions from the parties or be compensated based on the result.
Consumer dispute mediation is subject to the confidentiality obligation provided for by The Civil Procedure Rules (CPR) which promote the confidentiality of mediation under Part 31.
The parties remain free to submit their dispute to a judge under the applicable legal provisions.
Waiver
The fact that My-Beauty Academy does not invoke any of the clauses at a given time does not constitute a waiver of its right to invoke those same clauses later.
Non-solicitation of Personnel
The Client agrees not to poach or hire the personnel of My-Beauty Academy who have participated in the execution of the contract, during the entire duration of the contract and for two calendar years following the termination of the contractual relationship. In the event of non-compliance with this obligation, the client shall pay My-Beauty Academy a penalty equal to twelve times the last salary, plus employer contributions, of the improperly poached employee.
Jurisdiction
All disputes that cannot be resolved amicably shall be under the exclusive jurisdiction of the Judicial Court of Cannes, regardless of the location or residence of the Client, notwithstanding the presence of multiple defendants or third-party claims. This jurisdiction clause shall not apply in the case of disputes with a non-professional Client, for which the legal rules of material and geographical jurisdiction shall apply. This clause is stipulated in the interest of My-Beauty Academy, which reserves the right to waive it at its discretion.
Definitions
Client: Any professional or individual who is capable under the relevant UK law, or legal entity, who visits the Site governed by these general conditions.
Services: My-Beauty Academy provides the following services to Clients: [insert specific services offered].
